DOJ Will Assert Military and State Secrets Privilege and Request Dismissal of Lawsuit
 
San Francisco - The United States government filed a "Statement of Interest" Friday in the Electronic Frontier Foundation's (EFF's) class-action lawsuit against AT&T, announcing that the government would "assert the military and state secrets privilege" and "intervene to seek dismissal" of the case.
 
EFF's lawsuit accuses AT&T of collaborating with the National Security Agency in its massive surveillance program. EFF's evidence regarding AT&T's dragnet surveillance of its networks, currently filed under seal, includes a declaration by Mark Klein, a retired AT&T telecommunications technician, and several internal AT&T documents. This evidence was bolstered and explained by the expert opinion of J. Scott Marcus, who served as Senior Advisor for Internet Technology to the Federal Communications Commission from July 2001 until July 2005
 
Much of the evidence in the case is currently under seal, as AT&T claims public release of the documents would expose trade secrets. A hearing on the issue is scheduled for May 17th.

Don't think they won't get this one through - the over-protective attitude of several governments these days menas they can dish this sort of thing out with a huge dose of 'it is for your own good' to anyone who complains. You'll probably find they use a few oblique connections to laws like the US COPA, not to mention stuff like Homeland Security.

AT&T needs a kick up the rear Shocked for more than a few things these days.
 
For example, many of my family in the US are on an AT&T ISP, but we're now finding that all our emails bounce. My uncle mailed us (they can send okay) to say that AT&T considered my mother's ISP (Tiscali) to be a network entirely occupied by spammers, so had decided to block all Tiscali accounts.
 
AT&T's problem, but somehow it's mum's job to contact Tiscali administrators so they can come to some agreement with AT&T about unblocking all the email accounts from one of Europe's largest ISPs. AT&T can't even afford a spam filter, it seems. Aww, they must be short of a few bucks - care to make a donation? Wink

Hey, all they ask is Tiscali to make a reasonable effort to not sell access to spammers.  They are not the only one to do so, Citations available at request.
 
As to EFF (my being a government stooge), the EFF is interested in promoting its own agenda.  Information Gathering Techniques require not giving away what is being employed. In allowing the elimination of one method of communication monitoring, then you allow the enemies of all freedom a worry free method that they are not monitored.  Gee....instead of not knowing that my communcation on ATT is not monitored I know its not, because the EFF lawsuit discovery tells me so.
 
So instead of better intelligence, that is considered by most, to be at the root of the (9-11-01) bombing's success, we will have a worse time.  Besides Ian, Echelon is where most of this monitoring is easiest done, outside the USA.  We let the Brits monitor our citizens and we can get the raw data and the same for the reverse.  That way we are not monitoring our own citizens/residents who call Al'queda and neither are the Brits monitoring their own.  We can monitor each others and share the info.

Customer pressure is one thing, but to cut off family members from each other without any reason is cheap - they should install a spam filter, and then at least tell the sender why their email hasn't made it. Real people will appreciate it, and the spammers' robots will ignore it, but then things may get done. As it is, there's now a serious doubt as to the reliability of email to reach its destination.
 
I mean, I assume that my BT Internet email is getting through because no-one at AT&T has returned it to me. However, I sent hte last one with a delivery receipt and a read receipt requested - not a squeek heard from anyone. This is one major national teleco to another - don't these people talk?

it's too hot here at the moment - fractious ain't the word! I still like all the clips and stuff about the Blue Angels that my uncle sends me from time to time - I get mad that, because of someone else's decision, I'm not allowed to thank him by return of email.

Actually, the family in Florida have just switched away from AT&T to use NetZero accounts for talking with those in the free world. IIRC they still use AT&T for the majority of stuff, so it's not really a customer moving away from them - no customer pressure being exerted on AT&T, which is a shame, because I guess it cuts both ways.

Sad Yeah, unfortunately they have allowed ATT to start to buy up some of the smaller companies that came into existence from the break up of ATT/Bell in the 80's.  Still no where the market share that they use to have, back then.
